Terms and Conditions – Game of Skill
By entering the Seawind Ultimate Seawind 1160 Test Sail Competition, you agree to the following conditions:
1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
2. The Promoters are Seawind Group Holdings (ABN 53 002 692 864) of 25 York Place, Russell Vale NSW 2517 and Whitsunday Escape of Airlie Beach, QLD (Promoters).

Eligibility
3. Entry is open to Australian residents over 18 years only (Eligible Entrants), excluding directors, management, employees (and their immediate families) of the Promoters and its related bodies corporate and registered travel companions of employees of the Promoters and its related bodies corporate.
4. The promotion commences at 9.00am (AEDT) on Monday 19 December, 2011 and closes at 4:00pm (16:00) (AEDT) on Saturday 4 February, 2012 (Promotion Period). Only entries that are received during that time will be eligible for entry.

Competition entry
5. To enter, Eligible Entrants must, during the Promotion Period:

6. While the Eligible Entrant retains the copyright of all works submitted as competition entries, each entrant grants to the Promoters a non-exclusive, perpetual, irrevocable, royalty-free, world-wide license to use their entry in any media (including banners, signage, posters, television, magazine, Internet, MMS, DVD or other digital or print formats) for an unlimited time for any purpose, including but not limited to publishing the entries on the Promoter’s website, promoting future promotions and competitions of a similar nature, and whether or not in connection with the Promoter’s promotions, advertising or marketing. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth)
7. Incomplete, indecipherable, or illegible entries will be deemed invalid and will be rejected. The Promoters reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these terms and conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter’s absolute discretion and discussions will not be entered into. Entries that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain objectionable content or are otherwise inappropriate will be deemed invalid and will be rejected.
9. There is a limit of one entry per person for the duration of Promotion Period.
10. The Promoters reserves the right to verify the validity of entries and reserves the right to disqualify any Eligible Entrant for tampering with the entry process or for submitting an entry that is not (in the reasonable opinion of the Promoters) in accordance with these terms and conditions.
11. The Promoters is not responsible for any lost, late or misdirected entries.

Judging
12. The winners will be the entries judged by a panel of judges appointed by the Promoters to be the most creative and original answer from the pool of entries submitted during the Promotion Period. Entries will be judged at the offices of the Promoters at 4pm (AEDT) on Saturday 4 February 2012.
13. The competition is a game of skill and chance plays no part in determining the winner.
14. The winner will be notified by email by no later than 5:00pm (AEDT) on Tuesday 7 February 2012. If any prize remains unclaimed by 10.00am (AEDT) Tuesday 14 2012, another winner for each unclaimed prize will be judged by the panel of judges from the remaining pool of entries at 10.00am (AEDT) Tuesday 14 November 2012 and the winner will be contacted by email by 5:00pm (AEDT) on the same day.
15. The judges’ decision is final and the Promoters will not enter into correspondence regarding the result.
16. The winner’s name will be published on Seawind’s Facebook wall and in the Seawind eNews.
17. It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize.

The prize
18. There is one prize, valued at a maximum of AUD$4,000 based on the recommended retail value at the time of printing. The Promoters accepts no responsibility for any variation in the value of the prizes.
19. The major prize consists of:
• 7 nights Accommodation in a queen sized cabin onboard a Whitsunday Escape Seawind 1160 charter vessel from June 16 to 23, 2012 during the Seawind Whitsunday Rally event.
FREE regatta entry fees including up to six social races around the Whitsundays stopping at a new island each night.
VIP Entry to up to five parties and functions at different locations around the Whitsundays.
• Food supplies for the week onboard for self catering.
• Coaching by Multihull Central expert skipper – so you can be on the helm and become a better cat sailor!
• Note: Airfares and transfers are NOT included.
20. Accepting the major prize: Once notified the winner will need to provide the following information to the Promoters via email.
1. Full Names
2. Date of Birth
5. Expected arrival time at Airlie Beach.
6. Any special dietary requirements.

21. The winner and their travel companion are responsible for making their own way to and from the Seawind Whitsunday Rally departure port. The prize does not include travel insurance, passports, visas, taxes not included in the price of the ticket, ground transportation other than as stated or any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the prize-winner and their companion.
22. The prize must be taken as stated and no compensation will be payable if the recipient is unable to use the prize as stated. The prize is not redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoters.
23. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoters and which prevents the Promoters from complying with these terms and conditions, the Promoters will not be liable for any failure to perform or delay in performing its obligations and the Promoters reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
24. The Promoters, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
25. The exclusion of liability in clause 24 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoters in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoters in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions or
b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

26. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoters and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. By entering this competition, each Eligible Entrant releases Facebook from any action or claim arising out of the competition. Any questions, comments or complaints about this promotion must be directed to the Promoters and not to Facebook.
27. Seawind collects personal information about entrants for the purpose of running this competition. Entry details remain the property of the Promoters. Eligible Entrants consent to the Promoters using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes and sending informative updates and promotions by email.
